Debt Collectors Only Have the Power to Tell Lies and Make Threats of summons letter

Debt collectors know which lies and threats to use to prey on our guilt and fears about our indebted financial situation.

If you do not educate yourself at all about how to resist them, debt collectors can really play on your emotions. They will tell you:

All these lies are told over the phone.  That way, there is no record of them.

If you are intimidated into settling with a debt collector and making payments, they will take needless advantage of you and probably send

  • They will encourage small token payments so the debt re-ages and its statute of limitations time period is extended, and so you are on record as having admitted to the debt being yours, in case they decide to sue for the debt later.
  • They will inflate the debt by adding their own interest and fees to get more money out of you.
  • If you pay by check, they will use your checking account routing numbers to take more money out of your account claiming you approved payment of what you owed.

Debt collectors will put a negative listing on your credit report.  They will attempt to re-contract with you by asking you for more information, subtly attempting to get you to admit to the debt for legal purposes.

If you send a debt validation letter in response to a mini-Miranda notice from debt collectors, you may next hear from another debt collector about the same debt.  That actually means you are winning the battle because the first debt collector decided they did not want to deal with you.
